1. The Plaintiff (Counterclaim Defendant) paid KRW 26,50,000 to the Defendant (Counterclaim Plaintiff) and its related amount from August 14, 2015 to October 14, 2015.

A principal lawsuit and counterclaim shall also be deemed a principal lawsuit and counterclaim.

1. Facts of recognition;

A. On April 2014, the Plaintiff entered into a contract with the Defendant and Pakistan-si, setting the construction cost of KRW 245,300,000 for the construction work of Class II neighborhood living facilities on the ground C (hereinafter “instant construction work”). However, the contract document entered the Defendant as the contractor D and the joint and several sureties.

B. After that, around July 2014, the Plaintiff agreed to additionally construct the Defendant’s parking lot and its appurtenant work (a retaining wall construction and an appurtenant work) with the amount of construction cost of KRW 33 million, and paid the said construction cost of KRW 33 million from the Defendant.

C. Around November 13, 2014, the Plaintiff completed the instant construction. The Defendant paid to the Plaintiff KRW 243,200,000,000,000,000 on May 28, 2014; KRW 117,90,000 on June 19, 2014; KRW 26,36,190,000 on June 26, 2014; KRW 18,40,000 on July 10, 2014; and KRW 5,00,000 on August 4, 2014.

2. Determination on the main claim

A. The plaintiff alleged that he was entitled to KRW 32,80,000, in addition to the above initial construction cost of KRW 245,300,000, 1, 32,800,000, 2, 5,340,000, 3, basic c,670,000, 2,670,000, 4, 2,000, and 5,120,000 (including value-added tax) from the defendant and the construction of the instant construction.

Therefore, the Defendant is obligated to pay to the Plaintiff KRW 65,123,00 (i.e., the first construction cost of KRW 50,523,000,000 for additional construction cost of KRW 50,523,500 for corporate tax of KRW 7,500,000 for the interest payment of KRW 238,200 for the interest payment of KRW 230,00 for the interest payment of KRW

B. 1) First, the Plaintiff’s construction cost of the Defendant and the above construction work is KRW 328 million only on the sole basis of the statement of evidence No. 1, 1, as to the sn beam installation and re-snicker construction.
