A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
1. On May 2014, the Defendant, as a daily-service worker, was the victim D (in this case, 45 years of age) in the Section “C” located in Daegu Suwon-gu B, Daegu-gu, and took a school system from around August of the same year, and around two to three months were living together with the victim.
On June 20, 2014, the Defendant was working as a secretary in Section B of the Section “C” located in the Daegu Suwon-gu, Daegu-gu, and accessed the victim who was a new physician in Section B of the said Section, and “The monthly tax is approximately KRW 7 million,” and the monthly tax is paid, and the operation of Section B is difficult because there is no money as at the time it is necessary for operating expenses.
It is expected to lend 3 million won to another person and pay money to him/her after borrowing 3 million won.
“A false statement” was made.
However, the Defendant had no personal property at the time, while the Defendant had a personal obligation equivalent to KRW 700 million with debt 15 million with the former wife, and KRW 15 million with the loan borrowed from F under the name of the construction cost of the foregoing Section. The Defendant was unable to pay the rent for three months (7.8 million won per month). Thus, even if he borrowed money from the damaged person, the Defendant did not have any intent or ability to pay the money to the victim.
Nevertheless, the Defendant, as such, by deceiving the victim, received KRW 3 million in cash from the victim, i.e., from April 3, 2015 to April 3, 2015, received a total of KRW 95,449,299 from the victim, as stated in the list of crimes, or obtained a remittance from the victim.
2. In particular, the Defendant suffered special injury from the victim in G operated by the said victim in Daegu Suwon-gu, G on February 27, 2015, at around 01:00.
Whether there is any word without paying any money even though the date of the promise to resolve the money as soon as possible has passed.
In order to request the victim to repay the money borrowed as “,” the victim would be able to do so because it is too difficult for the victim to do so because it is too difficult to do so.
