A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

When the defendant is likely to suffer disadvantage in the appointment of public officials due to the previous conviction of indecent act by compulsion while preparing for the public official examination, he filed a false complaint against C and his male and female sex D, and tried to request a review of conviction based on the result of the complaint.

1. Around April 29, 2014, the Defendant: (a) prepared a written complaint stating that “A, the Defendant, at the Seoul Eastern District Prosecutors’ Office located in Asan-ro 404, Seoul, Gwangjin-gu, Seoul, shall be punished by using an examination color pen, and submitted it to an employee whose name is unknown at the above general civil petition room.”

Around July 23, 2014, the Defendant continued to make a statement to the prosecutor’s office of the Seoul Eastern District Prosecutor’s Office (Seoul Eastern District Prosecutor’s Office) to the effect that “D, on August 26, 2009, instigated the Defendant to file a false complaint with the effect that C was forced to commit indecent act by force from A, and instigated C to do so by force on May 10, 2010.”

However, on August 8, 2009, the Defendant: (a) committed indecent acts by compulsion, such as preventing the learning of the Defendant by one hand; and (b) raising other descendants on the shoulder of C and spreading the chest.

In this respect, the defendant was arrested for the purpose of having D receive criminal punishment.

2. On May 14, 2014, the Defendant, at the Seoul Eastern District Prosecutors' Office, located in Asan-ro 404 in Gwangjin-gu Seoul Special Metropolitan City, is located in the civil petition office of the Seoul Eastern District Prosecutors' Office.
