A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 17, 2018, the name inferer who is the cause of the telephone financial fraud organization, by deceiving the victim C by sending the victim a message “Isker D with the victim’s assistance at a non-place on December 17, 2018, using B, and sending the victim the message “Isker D with a mistake in the official certificate, but, at the same time, wired money again to the bank account (E) with the Defendant’s corporate bank (E) connected with the ck card leased as of December 2, 2018.”

Although the Defendant was aware of, or was predicted at least, the commission of the crime of telephone financial fraud, as above, the Defendant attempted to withdraw the amount of damage that the victim remitted at the G Bank Month Dong Financial Center located in Ulsan-gu, Ulsan-gu, under the direction of the person who was unable to receive his/her name on December 18, 2018 and transfer it to the account of the person who was unable to receive the said amount. However, the Defendant was discovered to the police officer who was dispatched upon receipt of the report from the bank staff.

Accordingly, the Defendant, by facilitating the aforementioned telephone financial fraud crime of the person who was not entitled to the above name, assisted it.

2. In using and managing the means of access, no person who violates the Electronic Financial Transactions Act shall borrow or lend the means of access, or keep, deliver or distribute the means of access, knowing that such means are to be used for any crime or to be used for any crime;

Nevertheless, between 13:00 on December 16, 2018 and 14:00, the Defendant, as described in the preceding paragraph, deposited or withdrawn and remitted the amount of damage, such as telephone financial fraud, etc., from the Gwangju-gu 904 at the Gwangju-gu G-type terminal, in order to receive or transfer the amount in cash, as described in the preceding paragraph, to the employees of Bosing singing singing singing singing sing sing sing sing sing sing sing sing sing sing sing sing sing sing sing sing sing sing sing ssing sing
