1. The Defendant each indicated in the attached Form 1, 2, 3, 4, and 1 among the 6,063.03 square meters of underground floors of the building listed in the attached Table list to the Plaintiff.
Reasons
1. Evidence 【A’1 through 4, witness C’s testimony and the purport of the whole pleadings;
A. On June 30, 2015, the Plaintiff entered into a lease agreement with the Defendant to lease the instant building with a deposit amount of KRW 5 million and KRW 500,000 per month on a ship (hereinafter “instant building”) that connects each point of (i) section 1, 2, 3, 4, and 1 attached drawings among the 6,063.03 square meters of underground floors of the building indicated in the attached Table with the Defendant on the attached list, by setting up a deposit amount of KRW 5,00,000 and KRW 5,000 per month of rent.
B. On July 23, 2015, the Defendant leased the instant building and registered the business with the trade name “Dice Deputy Director” and operated the Sejong Deputy Director on the instant building, but actually C was residing in the said Sejong Deputy Director and operated the Sejong Deputy Director.
2. The allegations by the parties and the judgment of this court
A. 1) The Plaintiff’s assertion and the period of lease was agreed to be one year with the Defendant.
B) As the Defendant’s counterargumentd Defendant demanded that the Plaintiff be forced to extend the term of lease to the Plaintiff for a short period of one year, not to benefit from facility investment, and that the Plaintiff would extend the term of lease, the Plaintiff’s one-year term of lease was set formally, and the period of one-year term was guaranteed five years pursuant to the Commercial Building Lease Protection Act, even if one-year term was set, and the actual Plaintiff and the Defendant agreed five-year term of lease between the Plaintiff and the Defendant. (2) In full view of the purport of the entire pleadings in the written judgment of this court, the Plaintiff and the Defendant may extend the term of lease from July 1, 2015 to June 30, 2016, by mutual agreement between the Plaintiff and the Defendant one-month period from the expiration of the term of lease to the expiration of the term of lease, and if the Defendant requests the renewal of the term of lease in accordance with the Commercial Building Lease Lease Protection Act. In addition, the above recognized facts and the Defendant’s request for the renewal of the term of lease to the Plaintiff.
