Reasons
Punishment of the crime
The Defendant, on September 23, 2013, 2013, had been operating the company as the representative director of the Kancheon-si Co., Ltd. Co., Ltd. Co., Ltd. Co., Ltd., Ltd., Ltd., located in Macheon-si prior to departure from the Republic of Korea on the Republic of Korea, and, as the financial situation has deteriorated due to the continuous settlement of the purchase price of goods and the debt has been gradually accumulated, he had been willing to provide funds under the method of disposal after purchasing the vehicle with installment financing loans.
1. On July 3, 2013, the Defendant filed an application for a loan of installment capital on the condition that “The Co., Ltd., a victim, will repay all the principal and interest of installment loans with interest of 7.47% per annum for the 60-month period under the condition that “The Co., Ltd., a member of the Co., Ltd., would purchase a loan of 87.0D import new revenue of 3.0D sports from the F Co., Ltd., which is the principal and interest of 8,78 million won.”
However, in fact, the above installment loans were purchased and disposed of within the short period after purchasing the said lelaber, but such circumstances were concealed, and there was no intention or ability to repay the principal and interest of the installment loans as agreed.
Around July 4, 2013, the Defendant, by deceiving the employees in charge as above, had the victim company implement the installment loan in the manner of paying 87,80,000,000 won to the F as the price for the vehicle of the said Lerober (G) on the part of the F, thereby having the victim company acquire the same pecuniary benefits.
2. On August 13, 2013, the Defendant purchased an I and J car at the Hnam Branch in Gangnam-gu, Seoul, on the condition that “The Defendant would repay all of the principal and interest of the installment loan with the interest of 6.89% per annum for 60 months, respectively, on the ground that it would be an employee in charge of the K-gu, the victim of the K-gu, the K-gu, the payment of the purchase price of I new car, KRW 408 million, the purchase price of J car, KRW 13 million, the purchase price of J car, respectively.”
