Defendant shall be punished by a fine of KRW 20,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No personal information manager shall exceed the purpose of performing his/her duties prescribed by statutes, etc. and provide a third party with personal information without obtaining consent from the subject of information.

The Defendant is a police officer who is in charge of the external and patrol duty at a police station in Yeongdeungpo-gu Seoul, Seoul, from February 4, 2015 to July 11, 2016, and from July 12, 2016 to April 25, 2017 at a police station in Yeongdeungpo-gu, Seoul, the police station in charge of the external and patrol duty at the police station in Yeongdeungpo-gu, Seoul, the police station in charge of the guard duty, and the personal information manager who manages a device to inquire about information of actors.

On February 29, 2016, the Defendant: (a) received a request from high school-friendly job offering F to inquire about whether or not he/she is entitled to nominateG; (b) received the said G’s resident registration number from the said F by a mobile phone text message; and (c) provided the said F with information as to whether or not he/she is entitled to nominate the said G by calls to the said F on March 26, 2016.

The Defendant exceeded the scope of the purpose of the performance of the official duties as above and provided personal information on whether he/she was designated by the owner of the information to the said F without the consent of G as the subject of information, as well as on July 1, 2015 through November 2, 2016, and provided it to F, H, I, J, J, K, L, L, M, N, N,O, P, and P, with a total of 63 times from July 1, 2015 to November 2, 2016 without the consent of the owner of the information.
