Reasons
Punishment of the crime
The Defendant is a physician with the outer department that operates the “E Council member” of the fifth floor of the building in Kimpo-si.
1. No medical person who has violated the Medical Service Act shall falsely prepare a medical treatment record, etc. or intentionally enter or revise any additional record differently from the fact;
Nevertheless, around May 19, 2016, the Defendant entered false information on the symptoms of “Necck Acss” in F’s medical records (in error, on April 1966), even though the Defendant provided a pair of cryp treatment to the patient F (F) who was admitted to the above E member, (F).
2. Fraud;
A. On August 5, 2016, the Defendant received KRW 1,670,510,00 in total from the injured party by claiming medical care benefits by changing the clinical disease as if he/she provided medical care benefits to G who was admitted to E members of the National Assembly, on September 1, 2016 and claiming medical care benefits from the injured party around that time, and received KRW 10,130,00 from June 2, 2016, from June 2, 2016 to June 1, 2017.
B. On March 31, 2017, the Defendant: (a) filed a claim with H to the National Health Insurance Corporation for reimbursement of KRW 1,300,000,00,000 for expenses, including medical examination fees, for the treatment of local smoking to E members; (b) around April 3, 2017, the Defendant filed a claim with the National Health Insurance Corporation for reimbursement of the medical examination fees; and (c) from June 2, 2016 to June 1, 2017, the Defendant received 10,460,000 won for medical care benefits from the victim; and (d) from June 2, 2016 to June 1, 2017, the Defendant filed the medical examination for non-benefit items as above 16 times as shown in the attached Table 2, including medical examination fees, from the victim of the National Health Insurance Corporation by claiming medical care benefits as if he/she provided medical treatment as if he/she received the benefits from the recipient.
