1. The Defendant’s KRW 60,000,000 and its amount shall be 15% per annum from March 13, 2019 to May 31, 2019 to the Plaintiff.
Reasons
1. To request the return of the lease deposit, which was terminated on September 15, 2017: Articles 208(3)1 and 257 of the Civil Procedure Act;
3. The amendment of the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings to the statutory interest rate was made from June 1, 2019 to the “interest rate prescribed by Presidential Decree” under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings. As such, only damages for delay calculated at the rate of 12% per annum from June 1, 2019 are recognized, and the exceeding part is dismissed.
