On the other hand, the argument that the defendant's act constitutes grounds for the dismissal of illegality under Article 310 of the Criminal Act is not a legitimate ground for appeal, as it is alleged in the ground of appeal that the defendant did not regard it as grounds for appeal or that it was not subject to judgment ex officio by the court below, and it does not constitute an unlawful ground for appeal.
