1. The defendant shall pay to the plaintiff the amount of KRW 953,587,575 and the amount of KRW 224,726,160 from July 10, 2018 to the date of full payment.
Reasons
1. Facts of recognition;
A. C Union set KRW 6,00,000 on April 29, 199 to the Defendant as the due date of May 29, 200, and set KRW 10,000 on May 28, 199 to the due date of payment as KRW 28,50,000 on May 28, 2000; ③ on October 18, 1999, KRW 195,000 on October 18, 199 to the due date of payment was set as KRW 18,000 on October 18, 2001; ④ on April 7, 2000, each of the loans was granted by setting the due date of payment as KRW 30,000 on April 7, 201.
(hereinafter referred to as "each of the loans in this case" in total, and individually referred to as "loan claim". B.
The defendant did not pay the principal of the first loan and the agreed interest and delay damages from September 7, 200, the principal of the second loan and the agreed interest and delay damages from April 14, 200, the principal of the second loan and the agreed interest and delay damages from April 14, 200, the principal of the third loan and the agreed interest and delay damages from April 14, 200, the principal of the fourth loan and the agreed interest and delay damages from May 13, 200.
C. C Partnership was declared bankrupt by the Incheon District Court on November 10, 200, and D on the same day, and on March 27, 2001, the Korea Deposit Insurance Corporation was appointed respectively as the bankruptcy trustee of the C Partnership.
C. On March 15, 2004, the bankruptcy trustee of the C Union filed a lawsuit against the Defendant seeking the payment of the loans 1, 3, and 4 (Seoul District Court Decision 2004Da19585), and on August 11, 2004, the judgment of the court below rendered a final judgment of 19.5% per annum from September 7, 2000 to the date of full payment to the date of full payment, with respect to KRW 6,00,000 per annum 19.5% per annum, 195,000,000 per annum from April 14, 200 to the date of full payment, to KRW 18.5% per annum, 30,000,000 per annum from May 13, 200 to the date of full payment, and 18.4% per annum from May 13, 200 to the date of full payment.
E. On January 14, 2005, the Korea Deposit Insurance Corporation in bankruptcy filed a lawsuit against the defendant for the payment of the second loan claims (the Incheon District Court 2005DaDa16150), and on January 26, 2005, the defendant 10,000 won with the Korea Deposit Insurance Corporation and its corresponding amount.
