1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

On July 16, 1998, the Plaintiff acquired Class 2 ordinary driving licenses and motorcycles driving licenses, Class 1 ordinary driving licenses on August 28, 2003, Class 1 large driving licenses on September 27, 2012, respectively.

At around 07:52 on May 27, 2014, the Plaintiff: (a) neglected to view B5t cargo vehicles from the outside-dong, Dong-dong Coastal Sea (hereinafter “instant cargo vehicles”); (b) neglected to perform the duty to turn to the left; (c) neglected to follow the vehicle line; (d) neglected to take necessary relief measures, such as implementation of rescue measures for the victim’s vehicle operating on the right line in the same direction, which the victim C drives at the same direction, to the right line and safety zone of the instant cargo vehicle; and (c) obstructed the victim E, F, and G with the instant cargo to the right line and the safety zone for each three-day medical treatment; (d) was inflicted on the victim and the victim E, F, and G with the said vehicle; (e) was damaged to the extent that the repair cost of the said vehicle, such as the exchange of front-time vehicles, etc.; and (e) went away from the scene of the accident by driving the vehicle without taking necessary relief measures for the victim.

On July 18, 2014, the Defendant issued a disposition revoking the Plaintiff’s respective driver’s license (hereinafter “instant disposition”) pursuant to Article 93(1)6 of the Road Traffic Act on the ground that the Plaintiff caused the instant accident and did not perform relief measures or duty to report even though he did not fulfill his duty to report.

As to the instant accident, the Plaintiff was charged with the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Doing Vehicle) and the violation of the Road Traffic Act (U.S.A.) on April 29, 2015, and the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (doing Vehicle) on the Aggravated Punishment, etc. of Specific Crimes (doing Vehicle) and the violation of the Road Traffic Act due to the failure to take a measure after property was damaged and sentenced to dismissal.

However, the prosecutor appealed to the Supreme Court No. 2015No485 and filed an appeal with the Ulsan District Court on January 2015.
