1. The plaintiff's appeal against the defendants is dismissed in entirety.
2.The preliminary claims shall be made at the trial of the political party.
Reasons
1. Basic facts
A. Status 1) On September 2007, it is deemed that the case is a commercial building in this case, which is completed around September 2007.
(2) A management body is a management body under the Act on the Ownership and Management of Aggregate Buildings (hereinafter “Act on the Ownership and Management of Aggregate Buildings”) composed of the sectional owners of the instant commercial building, and the Plaintiff is an organization established around June 25, 2013 by the tenants of the said commercial building to protect the rights and interests of the tenants of the instant commercial building, and to promote the commercial building, etc.
3) Defendant B operated “D” until February 2015 as the lessee of the instant commercial building 1, 148, and Defendant C as the lessee of the said commercial building 1, 301, from May 2010 to May 201, operated “E”. B. Around October 2007, the X-ray Co., Ltd. (hereinafter “EXE”) operated the said commercial building as the lessee of the said commercial building.
2) Meanwhile, at the managing body’s meeting of the instant commercial building held on October 25, 2012, a resolution was adopted to elect F as the Chairperson and to enact the management rules (hereinafter “resolution”). The executives of the A management body elected as above, around October 29, 2012, notified the EXN of the termination of the instant contract for the management of the commercial building after holding the management committee and resolving to terminate the entrusted management contract with the X-ray; 3) the EXN did not comply with the above termination notice; the A management body filed an application for provisional disposition, such as suspension of performance of duties, against the EXN under the jurisdiction of the central district court, and on May 20, 2013, the said court did not perform duties concerning the entrusted management of the instant commercial building; and the A management body.
