Punishment of the crime
[criminal records] Defendant B (before the opening of a name: D) was sentenced to ten months of imprisonment for fraud at the Seoul Southern District Court on April 21, 2016, and the judgment became final and conclusive on June 21, 2016. On June 24, 2016, the Seoul Southern District Court sentenced the Seoul Southern District Court to four months of imprisonment for fraud, and the judgment became final and conclusive on September 7, 2016.
[Criminal facts]
1. The structure of the crime of financing the entire-term loan for workers is operating the system of lending the entire-term loan for workers who lend at a rate lower than that of the market interest rate if an application for a loan is filed with only certain documents, such as a certificate of employment, a detailed statement of salary, and a lease contract, without any special security, to stabilize the residence of homeless workers with the financial resources of the National Housing Fund;
그러나 근로자 주택 전세자금 대출 관련 업무를 위탁 받은 금융기관이 형식적인 심사만 하고 대출을 해 준다는 사실을 알고, 대출 브로커들은 허위로 임차인과 임대인 역할을 하는 사람들과 함께 근로자 주택 전세자금 대출금을 가로챌 것을 계획하였다.
Accordingly, the loan broscers engaged in the following tasks: (a) one person who is a nominal holder of a loan, prepares a false employment document and a written lease agreement for a lessee; and (b) the false lessee again submits it to a financial institution; (c) files an application for a loan for the employee’s lease of housing; and (d) one person, who is acting as a lessor, can confirm the fact that a lease contract was actually entered into by a financial institution; and (c) one person, who is acting as a broscers, requested a loan for the employee’s lease of housing and received the loan after the receipt of the loan.
2. Specific facts constituting a crime are false lessors, Defendant A is a false lessee, and workers from financial institutions using false certificates of employment, a lease contract, etc. with E (one person F) which is a hub for loans.
