A is the representative director of B who operates the web site ‘C', and the defendant B is a corporation established for the purpose of online contents operation and management business.

1. Defendant A was aware of the fact that various data traded through the above website were illegal online contents, such as motion pictures without obtaining permission to use copyright.

Nevertheless, the defendant allowed the above site members to download various online contents on the above site and allowed other members to download online contents on the above site.

As can be seen, the Defendant did not take appropriate measures to prevent infringement with the knowledge that online contents subject to author’s property rights are illegally distributed through the above website, and instead, neglected all kinds of online contents subject to protection of the author’s property rights offered by its members, and allowed its members to download online contents using points, and caused its members to download online contents through the Damon class, while implementing the Damon rating system, set up 20 to 40% points of the Dand amount, and wanting to exchange cash in cash, 50% of the accumulated points in exchange for online contents business operators.
