A defendant shall be punished by imprisonment for not less than two months.

Punishment of the crime

1. On May 23, 2013, the Defendant posted a false statement on the “G” page of the Internet site “Nene” to the “G” page, and reported the fact that he/she would sell a gallonian-2 mobile phone, thereby sending a gallon-2 mobile phone to the victim AH who visited the victim, who deposited KRW 3.50,000 won.”

However, the defendant did not have any intention or ability to send the above things even if he receives the price because he did not have the above things.

Nevertheless, the Defendant, as seen above, was accused of the victim and transferred KRW 350,000 from the victim to the bank account in the name of the Defendant.

2. On May 26, 2013, the Defendant posted a false statement on the “G” page of the Internet site “Nene” to the “G” page, and reported the fact that he/she would sell a galthot 2 mobile phone, thereby sending a galthot 2 mobile phone to the victim AI who visited the victim with the fact that he/she would deposit KRW 350,000 won.”

However, the defendant did not have any intention or ability to send the above things even if he receives the price because he did not have the above things.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 350,000 from the victim on May 26, 2013 to the account in the name of the Defendant.

3. On June 7, 2013, the Defendant posted a letter to the “AJ” on the Internet site to sell a gallonian 2 mobile phone at the gallon site, and falsely said that “When deposit KRW 350,000,000 is made, the Defendant would send a gallon 2 mobile phone.”

However, the defendant did not have any intention or ability to send the above things even if he receives the price because he did not have the above things.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 350,00 from the victim on June 7, 2013 to the account of community credit cooperatives in the name of the Defendant.
