1. The Defendants jointly share KRW 20,000,000 with respect to the Plaintiff and 5% per annum from May 16, 2015 to June 23, 2016.

1. Basic facts

A. From around 2010, the Plaintiff installed vinyl 5,753 square meters in 2010, and cultivated and sold the mountain urgical son.

Defendant B’s agricultural cooperative (hereinafter “Defendant cooperative”) is a business entity engaging in pesticide sales, and Defendant C is an employee in charge of pesticide sales in the Defendant cooperative.

나. 원고는 2015. 2. 9. 피고 C에게 산딸기의 잎과 줄기를 가져와 진단을 부탁하였고, 피고 C은 이를 현미경으로 관찰하여 응애, 진딧물이 발견된다고 보아 팬텀, 푸름이, 알타코아, 지존이라는 농약을 살포할 것을 추천하였다.

이에 원고는 같은 날 피고 C으로부터 위 농약들을 구매한 후, 2015. 2. 13. 산딸기 시설하우스에 팬텀 2병 등 처방받은 농약을 살포하였다.

다. 원고는 2015. 2. 15. 산딸기 시설하우스에 수정벌을 방사하는 등 수차례 수정벌을 방사하였으나 위 농약 중 팬텀의 잔류 독성으로 인하여 수정벌이 폐사하거나 수정 능력을 상실하였고, 이로 인하여 산딸기의 수분이 이루어지지 않아 수확량이 감소하였다.

2. Determination as to the establishment of liability for damages

A. The Plaintiff’s assertion 1 Plaintiff’s assertion that the Defendants, as employees in charge of the sale of agrochemicals, provide accurate explanations about the performance, method of use, etc. of agrochemicals at the time of selling agrochemicals as well as prescribing and selling agrochemicals that are prohibited from spraying agrochemicals due to the toxicity of the modified punishment. As such, Defendant C is liable to compensate the Plaintiff for the damages suffered by the Plaintiff as the Defendant C’s employer.
