Punishment of the crime

On July 16, 2014, A was sentenced to imprisonment with prison labor for a crime of fraud, for a period of one year, for a suspended sentence of two years, and for a judgment on July 24, 2014. On April 19, 2016, the same court was sentenced to imprisonment with prison labor for a year, for a suspended sentence of two years, and for a fine of five million won for the same crime, and the judgment on April 27, 2016 became final and conclusive.

1. The Defendants, who committed the joint crime from the end of July 2014 to August 1, 2014, had been engaged in development activities on the 2,97 square meters of H forest in Haju, and filed a civil petition on the grounds that the soil of neighboring residents occurred. As such, the Defendants were willing to install illegal structures, such as reinforced soil retaining walls, without obtaining permission for the development activities of the main market in the above development area and its neighboring areas.

The Defendants conspired, from the end of July 2014 to August 20 of the same year, installed a reinforced soil retaining wall of a size of 41.4m in length and of a height of 1 to 2m above 364m in forests and fields for which no permission for development was obtained among the above H forests and fields from the end of the same year, and changed the form and quality of land without obtaining permission for the original market.

B.
