1. Defendant A shall be punished by imprisonment for a period of eight months and by a fine of seven thousand won.

The above fine shall not be paid by the defendant.

Punishment of the crime

Any person who intends to engage in foreign exchange business, such as payment, collection, receipt, etc. between the Republic of Korea and a foreign country, shall prepare sufficient capital, facilities and experts in foreign exchange business and register in advance with the Minister of Finance and Economy.

1. From April 28, 2013, Defendant A operated a transshipment center with the trade name “F” in Suwon-si E, Suwon-si, Defendant A was willing to receive fees from those who wish to remit money between the Republic of Korea and China, including profits arising from exchange rate differences, and intended to engage in foreign exchange business based on the “recoveration”.

A. On May 12, 2013, upon request from G to China, the Defendant received KRW 1 million from the above “F” to the national bank account under the name of the Defendant (Account Number H), including the profits arising from exchange rate differences, and then remitted the amount of decentralization to the Chinese financial account designated by the Defendant using Internet banking in the first Chinese construction bank account, etc. under the name of the Defendant’s management, as indicated in the attached Table No. 1 to 1057 of the crime list No. 1 to 1057. On May 11, 2013, the Defendant transferred the money to the remitter designated by the remitter, as described in the attached Table No. 1 to 10 to 100,90,000 won from the remitter’s account under the name of the Defendant to the Chinese construction bank account under the name of the Defendant, and transferred the money from the remitter to 2 to 300,000 won to 20,011 to 2015.

B. On May 14, 2017, the Defendant received a request from a person whose name is not known from the F to China to transfer the said bill to China.
