1. Facts of recognition;

A. Nonparty C holds a license for Do private taxi transport business, and owned private taxi vehicles (hereinafter “Plaintiff-owned vehicles”) according to the above license, and is a member of the Plaintiff’s association.

B. The Defendant is a mutual aid business entity that entered into a mutual aid agreement with respect to F vehicle (hereinafter “Defendant vehicle”).

C. On June 6, 2019, around 09:40 on June 6, 2019, the Plaintiff’s vehicle proceeded with the intersection of the Seocho-gu Seoul Metropolitan Government G (hereinafter “instant road”) in accordance with the straight line from the new distribution channel to the high-speed terminal room.

2. Determination

A. The following circumstances, which can be recognized by comprehensively considering the evidence and the purport of the entire pleadings as revealed in the above facts of the negligence ratio, namely, ① the Plaintiff’s vehicle at the time of the accident, along the three-lanes of the instant road, which is the four-lanes of the instant road and then changing the course to the two-lanes of the said road to the right side of the said road, ② the Defendant’s vehicle enters the instant road bypassing from the right side of the said intersection, and attempted to change the course immediately from the four-lanes of the said intersection, ③ the Defendant’s vehicle is going back to the right side of the said intersection, ③ the safety zone in the process, ④ the Defendant’s vehicle is changing to the course, ④ the safety zone in the course, and the safety zone close to the four-lane angles to the right side.
