A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who was in a relationship with the victim D (V, 42 years of age).

1. Around 22:00 on November 29, 2015, the Defendant: (a) confirmed the Victim’s Kakakao Stockholm message in Seoul Special Metropolitan City, Nowon-gu around 22:00 and sent the Victim’s face to the other male; (b) expressed that “I am scar, come so, governance face, respect, or satis; I am am satis, I am satis, I am the Victim’s face; and (c) am the Victim’s face with his hand when I am the Victim’s face with his hand, I am a glass view by breaking the Victim’s face; and (d) when I am the Victim’s face with his hand.”

2. The Defendant destroyed and damaged property by gathering one unit of Samsung Gallon Nono-4 Smartphone in an amount equivalent to one million won at the market price, which is the victim’s ownership, at the time and place set forth in the above paragraph (1).

3. The Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Special Rape) stated in the above paragraph (1), at the time, place, “the victim will be able to send a male-friendly test by affixing a fluore image which is a dangerous object under the above paragraph (1) to the victim’s face, and made it possible for the victim to resist the victim by threatening the victim to “Isu, Chosia...............” The Defendant collected the Defendant’s sexual organ at the victim’s entrance, inserted the Defendant’s sexual organ into the victim’s sexual organ, inserted the Defendant’s sexual organ once in the victim’s sexual organ.

Accordingly, the defendant carried dangerous objects and raped the victim.

4. The Defendant violates the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Ameras, Use and galographing) shall do so by rapeing the victim at the time and place under the above paragraph (1), and at the same time and place under the above paragraph (3).
