이에 피고인들과 D는 2014. 4. 2. 21:00경 전남 곡성군 H에 있는 E대학 청람교육원 뒷산으로 피해자 G, I, J, K, L, M, N, O, P, Q, R, S, T, U, V 등 15명의 피해자들을 불러낸 다음, 평소 선배들의 말을 잘 듣지 않는다고 질책하면서 그들로 하여금 머리를 땅에 박게 하고 그러한 상태에서 피고인 B은 피해자 중 I, P, M, O, R, Q, N, G, L, K, J의 허벅지를 발로 수 회 찼다.

계속하여 피고인 B은 위 피해자 전부를 일어서게 한 후 피해자 중 I, P, M, O, R, Q, N, G, L, K, J의 가슴 부위를 주먹으로 수 회 때리고, 피고인 A은 발로 피해자 O의 머리를 1회 차고 손바닥으로 피해자 J의 뺨을 5회 때리고, 공범 D는 주먹으로 피해자 G의 가슴을 1회 때리고 발로 그의 배를 1회 찼다.
