1. The Defendant shall pay to the Plaintiff KRW 40,00,000 and the interest rate of KRW 15% per annum from April 20, 2016 to the date of complete payment.

Comprehensively taking account of the purport of the entire arguments in Gap evidence Nos. 1 and 4, the Plaintiff transferred KRW 40,000,000,000, including the total amount of KRW 30,000,000 on November 6, 2015, from the account under the name of the defendant to the account under the name of the defendant, and KRW 40,000,000,000 on February 12, 2016, and ② thereafter, the Defendant repaid KRW 40,00,000 to the Plaintiff until March 30, 2016.

“A” may be recognized that the certificate of borrowing (No. 1) has been drawn up and issued.

According to the above facts of recognition, the defendant is obligated to pay to the plaintiff the above 40,000,000 won and damages for delay at the rate of 15% per annum from April 20, 2016 to the day of full payment, which is the day following the delivery of the complaint of this case.

Therefore, the plaintiff's claim of this case shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
