그럼에도 피고인은 2015. 10. 30.경부터 2016. 5. 25.경까지 전항과 같은 장소에서 그곳을 찾아온 D 등 불특정 다수의 여성 노인들을 모아 놓고, '사이클론 라파칼슘 플러스‘는 “칼슘이 많이 들어 있어 뼈에 좋고, 연세 드신 분들은 골다골증, 관절염에 치료 효과가 있다.”라고 하여 1박스(3병, 1병당 1.2g 10포)에 8만 원에 구입한 '사이클론 라파 칼슘 플러스‘를 1박스당 20만 원씩, 36 내지 40박스, 총 7,200,000∽8,000,000원 상당을 판매하고, ’콜라겐 골드 900‘은 “피부노화를 방지하고, 관절염, 골다골증의 치료와 예방에 효과가 있다.”라고 하여 1병(100g분말)에 5만원에 구입한 ’콜라겐 골드 900‘을 1병당 12만 원씩, 30병, 총 3,600,000원 상당을 판매하였다.
