가. 원고는 2005. 1. 3.경 업소용 금속제 와인 냉장고, 의료기관 영안실용 사체냉장고 등을 제작하는 업체인 (주) 청우정공에 입사하여 근무하여 온 근로자인데, 2011. 12. 23. 15:00경 동료근로자 2명과 함께 업소용 냉장고 실외기를 4단에 적재하는 작업을 하다가 허리와 몸을 삐끗하는 사고를 당하였고, 이로 인하여 ‘추간판탈출증, 요추 제4-5번간’(이하 ‘이 사건 상병’이라고 한다)이 발병하였다고 주장하면서 2012. 5. 2. 피고에게 이에 대한 요양급여신청을 하였다.

가. 원고의 주장 원고는 소외 회사에서 약 7년 동안 중량물을 취급하는 작업을 수행하면서 허리에 과중한 부담을 받아 왔는데, 이러한 상태에서 작업도중 허리와 몸을 삐끗하는 사고를 당한 후 이 사건 상병을 앓게 되었다.

Thus, the injury of this case constitutes an occupational accident caused by the combination of the burden accumulated in the course of performing duties with the above accident, and the disposition of this case on a different premise is unlawful.
