A defendant shall be punished by imprisonment for one year.

Punishment of the crime

Around July 2011, the Defendant, “2013 Highest 102,” as a person operating a livestock product dealer under the name of C, continued to operate the Plaintiff due to difficulties in management, such as decline in the prices of chickens, etc. The Defendant did not have any particular monthly income, and the Defendant did not have any intent or ability to pay the price even if he was supplied by C with earth and sand, on the grounds that there was 200 million won of personal debt and 400 million won of bills, and there was no obligation to pay the price.

1. Nevertheless, the Defendant, at around 00:30 on July 26, 201, by deceiving the victim as if he would pay the price for supply of earth and sand at the “F farm located in Dong-gu, Chungcheongnam-gu, Dong-gu, Seoul, Seoul, by deceiving the victim, and then by deceiving the victim with 4,020 Kg of the amount equivalent to KRW 15,276,00.

Nevertheless, on August 5, 2011, the Defendant, at around 00:12, by deceiving the victim as if he would pay the price of supply of earth and sand at the same place as the above Paragraph 1, and by deceiving the victim, he was supplied with 27,456,00 won and acquired 8,320 Kg of earth and sand, which is equivalent to KRW 27,456,00.

3. Nevertheless, around August 21, 201, the Defendant, at the same place as the above Paragraph 1 of the same Article, by deceiving the victim as if he would pay the price for supply of earth and sand at the same time as the above Paragraph 1 of the same Article, and by deceiving the victim, he was supplied with earth and sand chills equivalent to KRW 12,847,00,00 and acquired it by deception.

As such, the Defendant was supplied with earth and sand equivalent to KRW 55,579,000 in total on three occasions, and acquired them by deceit.

The Defendant is a person who operates a livestock product selling company under the trade name, called Pyeongtaek located in Pyeongtaek-si G.

On June 201, the Defendant stated that “The Defendant would send the chickens to the victimJ operating an I farm located in Dong-gu, Dong-gu, Dong-gu, Dong-gu, Haban-gu, Haban-gu, Haban-gu, and pay the Hack's money within one month.”

However, the defendant, at the time, has continued to operate the enemy of the above C, paid the price of supply to the customer by means of the bill settlement, and the amount of the bill is more than 400 million won.
