1. The Defendant’s KRW 56,00,000 as well as the Plaintiff’s annual 6% from October 26, 2019 to February 5, 2021, and the following.
Reasons
1. Facts of recognition;
A. On December 11, 2018, Nannam-do: (a) concluded a contract on the goods contract with Nananananan-gun on February 7, 2019, with a limited liability company C (hereinafter “C”) on December 19, 2018, for the purpose of purchasing the engine mobile acquisition equipment within budgetary limits of KRW 640,409,850 (No. 1 evidence); and (b) concluded a contract on the said contract on April 9, 2019.
The main contents of the contract entered into with C are as follows (the result of inquiry into the facts about Eul's certificate and the new draft group of this court; hereinafter referred to as "prior contract of this case"). The contractor of the contract in South-do: The name of the other party to the contract in South-do: the name of the other party to the contract: the name of the purchase of engine mobile transfer equipment: 45 contract amount: 59,020,160 won: the engine pumps, quantity: 59,020,160 contract amount: the delivery period until June 10, 2019: the delayed prize rate by June 10, 2019: 0.08%.
C. C on April 16, 2019, transferred to the Defendant the claim against the new security unit based on the instant prior contract (Evidence B No. 1). On May 22, 2019, the new security unit consented to the said transfer (Evidence B 2).
On May 14, 2019, the Plaintiff prepared a contract with the Defendant with the following contents, and entered into a contract for the purchase of goods with respect to the engine type transfer type acquisition equipment 45 feet (hereinafter “instant facilities”) under the instant prior contract (hereinafter “instant contract”). The ordering agency: The name of the Plaintiff: The total contract amount for the purchase of engine type transfer type transfer acquisition equipment under the instant prior contract with the Defendant: 50,000,000 (including value-added tax): 275,000,000 won (including value-added tax): 60 days after the contract: 60 days after the designation of other matters: the designated amount; the place of delivery; 50% after the completion of the contract; 50% after the payment of the remainder; 50% after the completion of the contract;
E. The Newan Army extended the delivery deadline on three occasions on September 30, 2019.
