피고인들은 성명불상자들과 함께 인적이 드문 야산에 심야시간을 이용하여 대형 천막을 설치하고 도박참가자(일명 ‘찍새’)들을 모아 일명 ‘도리짓고땡’이라는 도박을 한 후 새벽녘에 천막을 걷고 해산하는 일명 ‘산도박’을 위한 도박장을 개설하기로 마음먹었다.
