1. The Defendant shall pay to the Plaintiff KRW 170,00,000 and the interest rate of KRW 15% per annum from January 15, 2019 to the date of full payment.

Reasons

On June 11, 2015, the Plaintiff entered into a lease agreement (hereinafter “instant lease agreement”) with the Defendant to lease the Busan Dong-gu C building and D (hereinafter “instant building”) KRW 170 million from June 28, 2015 to June 28, 2016 (hereinafter “instant lease agreement”). The instant lease agreement is implicitly renewed, and the Plaintiff agreed to terminate the instant lease agreement with the Defendant on September 2, 2018 by delivering to the Defendant his/her intent not to renew the instant lease agreement on or around April 2018. The Plaintiff did not dispute between the parties to the instant building or may recognize the purport of the entire pleadings by comprehensively taking into account the descriptions and video numbers of subparagraphs 1 through 3, 5, and 6 (including numbers).

Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 15% per annum from January 15, 2019 to the day of full payment, which is the day following the delivery of the copy of the claim and the application for modification of the cause of the claim as of December 31, 2018, the claim of this case as of December 31, 2018.

Therefore, the plaintiff's claim of this case shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
