Reasons
Punishment of the crime
1. Around February 4, 2015, the fraud Defendant reported the victim F’s writing posted to the effect that he/she would want to purchase a mobile phone on the Internet “China” website at the Defendant’s residence in Jung-gu Seoul, Jung-gu, Seoul, and made a false statement to the victim that “I would send a 500,000 won phone 6 flus if you send it to the victim.”
However, even though the defendant had only one fluor 6 flus purchased at the time, he did not have the intent or ability to send the fluor 6 flus to the victims of the Aphone6 even if he did not receive the money from the victim, because he thought that he would sell the flus to the victims of the Aphone6.
The Defendant, by deceiving the victim as above, received KRW 500,00 from the victim’s corporate bank account (G) in the name of the Defendant on the same day, and received KRW 29,781,500 in total from January 24, 2015 to April 20, 2015 in the same manner as shown in the annexed Table 1 in the same manner.

On April 13, 2015, the Defendant attempted to commit fraud: (a) reported the victim H’s writing posted to the effect that he/she would want to purchase a bicycle on the Internet “China” website at the above place; and (b) made contact with the victim and sent a bicycle in contact with the victim.”
However, the defendant did not have a bicycle for sending the victim at the time, so even if he received money from the victim, he did not have the intention or ability to send the bicycle to the victim.
As above, the Defendant had attempted to receive money from the victim by deceiving the victim as above, and had attempted to receive money from the victim through the same method from around that time to April 20, 2015. The Defendant received money from the victims on six occasions, such as the list of crimes in attached Table 2, from around that time.
