1. The plaintiff's lawsuit against the defendant Geum-dong Corporation shall be dismissed.

1. Basic facts

A. 1) The Korea National Housing Corporation (hereinafter “the instant apartment”) shall enter into a contract on the commercial apartment located in Pyeongtaek-gu, 69-gil-ro, Gyeongsan-ro (hereinafter “instant apartment”).

The Plaintiff is an executor who newly built and sold the land in lots. On October 1, 2009, the Plaintiff comprehensively succeeded to the property, claims, and other rights and obligations of the Korea National Housing Corporation (hereinafter “the Korea National Housing Corporation”) to a public corporation established following a merger between the Korea National Housing Corporation and the Korea Land Corporation (hereinafter “Plaintiff”).

(2) On July 31, 2001, among the instant apartment construction project, the Plaintiff awarded a contract for the information and communications construction work to Defendant Geum-gu Co., Ltd., Ltd. on November 10, 2001 for the construction, machinery and civil engineering work, and the construction work to Seo Chang-gu Co., Ltd., Ltd (hereinafter “Seo Chang-gu”) on November 10, 201, and for the information and communications construction work to Defendant Ba-si Co., Ltd on November 6, 2001.

3) On July 31, 2001, the Plaintiff, among the two sections of the instant apartment construction (101, 104, 111, 113, and neighborhood living facilities) construction, the construction, machinery, and civil engineering works for the Defendant Hoban Construction, Geumban Construction, and the computer installed by the Defendant on November 10, 201, and the information and communications construction works for the Defendant Kuban Communications on November 6, 2001. (B) On November 1, 2001, the Plaintiff concluded an information and communications construction contract with the Defendant Construction Mutual Aid Association for the defect liability warranty contract with regard to the construction, machinery, and civil engineering works for the instant apartment.
