[Defendant A] The defendant shall be punished by imprisonment for ten months.

However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

그럼에도 불구하고 피고인들은 (1) 2013. 1. 1.경부터 2014. 3. 14.경까지 ‘G'라는 인터넷 쇼핑몰을 통해, ① 상표권자 ’H‘이 2002. 5. 30. 대한민국 특허청에 등록번호 제0005506호로 상표 등록한 KFA(KOREA FOOTBALL ASSOCIATION) 상표가 부착된 대한민국 축구대표팀 유니폼, ② 상표권자 ’페데라시옹 프랑세즈 드 풋볼‘이 2010. 12. 1. 대한민국 특허청에 등록번호 제0846904호로 상표 등록한 상표와 유사한 상표가 부착된 프랑스 축구대표팀 유니폼, ③ 상표권자 ’아스날 풋볼 클럽 퍼블릭 리미티드 캄파니‘가 2005. 12. 15. 대한민국 특허청에 등록번호 제832422호로 상표 등록한 상표가 부착된 아스날 풋볼 클럽 유니폼, ④ 상표권자 ’첼시 풋볼 클럽 리미티드‘가 2012. 7. 16. 대한민국 특허청에 등록번호 제865293호로 상표 등록한 상표가 부착된 첼시 풋볼 클럽 유니폼, ⑤ 상표권자 ’맨체스터 유나이티드 리미티드‘가 1999. 12. 14. 대한민국 특허청에 등록번호 제0460697호로 상표 등록한 상표가 부착된 맨체스터 유나이티드 클럽 유니폼을 불특정 다수인에게 판매하여 약 233,861,600원 상당의 수입을 올리고, (2) ① 위 ’H‘의 상표가 부착된 국가대표팀 연습복 상의 20개, ② 위 ’페데라시옹 프랑세즈 드 풋볼‘의 상표가 부착된 프랑스 대표팀 유니폼 11개, ③ 위 ’H‘의 상표 340개, ④ 위 ’아스날 풋볼 클럽 퍼블릭 리미티드 캄파니‘의 상표 65개, ⑤ 위 ’맨체스터 유나이티드 리미티드‘의 상표 280개, ⑥ 위 ’첼시 풋볼 클럽 리미티드‘의 상표...
