A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. 폭력행위 등 처벌에 관한 법률 위반(집단흉기등협박) 피고인은 2014. 5. 19. 00:30경 서울 동대문구 C아파트 후문 D편의점 앞에서, 술에 취하여 아무런 이유 없이 피해자 E(24세), 피해자 F(24세)에게 “야 씹새끼야, 죽여버린다”라고 욕설을 하면서 위험한 물건인 맥주병을 피해자들에게 휘두르고, 위 맥주병을 던져 깨트린 다음 겉옷과 신발을 벗고 이소룡 흉내를 내면서 “야 개새끼들아, 씨팔새끼야 덤벼봐! 다 죽여버린다”라고 욕설을 하고, 손으로 피해자 E을 때릴 것처럼 손을 올리면서 가까이 다가가 위협하고, 피해자 F의 가슴과 목 부분에 머리를 부딪치면서 들이대는 등 위협하여 피해자들을 협박하였다.

2. At around 00:50 on the same day, the Defendant: (a) tried to verify whether the police officer assigned a police box to the Seoul Eastdong Police Station in receipt of a report from the said victims committed the above acts against the Defendant; and (b) subsequently, the Defendant: (c) took a bath to “I ambling to her head, whether he is a police officer or not,” and obstructed police officer’s lawful performance of duties concerning the handling of the reported case, by assaulting him, such as sprinking the 112, when she was sprinked.

3. At around 03:10 on the same day, the Defendant threatened the victims on the ground that the victims referred to in the above 1.12 report at the criminal office and office of the Seoul Dongdaemun Police Station, and on the ground that the victims referred to in the above 1.12 report, the Defendant reaffirmed the form of knife knife to the said victims, saying, “I find a fine on the face of this knife, I then die in the knife with a knife, knife, knife, and knife with the face.”
