1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On March 2018, the Plaintiff filed an application with the Defendant for a building permit including an application for development activities, a request for consultation on conversion of farmland, and a request for consultation on conversion of a mountainous district, in order to newly construct a detached house with a size of 176.62 square meters and a total floor area of 232.82 square meters on the ground of 424 square meters, C forest land, and D forest land (hereinafter collectively referred to as “instant application site”).
B. On May 11, 2018, the Defendant rendered a non-permission disposition against the Plaintiff on the following grounds (hereinafter “instant disposition”). A.
Land that has applied for development activities in conflict with surrounding landscape and environment is located at the coast price, and surrounding land is in progress with the determination of the ecosystem conservation zone and the announcement of topographic drawings in the net city for the preservation of E, and is provided for in Article 56 [Attachment Table 1-2(d)(1) and (2) of the Enforcement Decree of the National Land Planning and Utilization Act and Article 56 [Attachment Table 1-2](d) and (2) of the National Land Planning and Utilization Act and Article 1-2-1(1) of the Guidelines for Operation of Permission for Development and Utilization provide for the "competing with surrounding landscape and environment
According to Article 56(4) of the Enforcement Decree of the National Land Planning and Utilization Act in conflict with the operation guidelines for permission for development activities, and Articles 56(1)2, 2-1-3(2) and 3 of the Operational Guidelines for Permission for Development Activities, “The restriction on the location of buildings to be constructed on the coast of a landscape string, the land from the coast to the coast shall, to the maximum extent possible, restrain the construction of buildings, etc., to preserve natural conditions and protect the landscape of the coast that is visible from the coast to the coast, and the application concerned goes against the criteria for permission for development activities.”
