1. The plaintiff (Counterclaim defendant)'s main claim is dismissed.

The plaintiff (Counterclaim defendant) is the defendant (Counterclaim plaintiff) on 19,047.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

Facts of recognition

The Plaintiff related to the parties is a person who, around November 2012, awarded a contract to the Defendant for construction of a Ddog factory on the ground of 2,587 square meters of land for a factory in Jeonsung-gun owned by him/her (hereinafter “instant construction”). The Defendant is a person who completed the said construction upon contract with him/her.

In preparing for the instant construction project in the course of the modification of the construction drawing, the Plaintiff obtained a building permit for the instant construction project from Masung-gun through an architect E on March 31, 201, and the design drawing attached at the time was to newly construct five buildings with 1 Dong, 1 Dong, 1 Dong, 2 Dong, 2 Dong, 3 Dong, 4 Dong and 4 Dong (total area of 651.96 square meters).

On November 22, 2012, the Plaintiff filed an application to change the number of buildings and the area among the contents of the construction permission through the architect E. On November 22, 2012, the Plaintiff had newly constructed four Dong buildings (a total of 625.1mm2) with the Dogdong factory (a week), warehouse (a Dong and a Dong 2 Dong), and the office (a Dong 3 Dong) attached to the design drawings (A7-1).

On December 5, 2012, Sung-gun permitted the above application.

On February 7, 2013, the Plaintiff filed an application for re-issuance of the number of buildings and the size among the contents applied for the said modification with the Sung-gun through an architect E, and the design drawings (A7-2, B-1) attached at the time were to newly construct two identical factories with the number of buildings, storages, offices (A7-2, B-1), and agricultural product processing facilities and 131.14 square meters of agricultural product processing facilities and 131.14 square meters of office (a 1 Dong).

On February 20, 2013, Sung-gun permitted the above application.

On March 5, 2013, the Plaintiff entered into a contract for construction works and the Plaintiff’s commencement of construction works with the Defendant, with the term “273 million won”, “10 million won in advance,” “53 million won in completion,” “53 million won in the arrival at the site of the panel,” “the commencement date, March 9, 2013,” “the completion date, April 30, 2013,” and “the completion date, April 30, 2013,” and agreed with the owner on the contract for construction works of this case.
