A worked as the representative director of the Defendant Company B from April 1, 2007 to March 31, 2013, while managing and operating the business and manufacturing sector. The Defendant Company B was a corporation established for the purpose of gold-type manufacturing business and the business of producing speculative products. From February 23, 2010 to April 20, 2012, it entrusted H with the manufacture of painting 310, G310, G310 CAP CAP CABL and other 209 CAP CAP 209 CABL.

1. Where a principal contractor entrusts a subcontractor with manufacturing, etc., he/she shall not reduce the unit price by a uniform rate, without justifiable grounds, or determine the subcontract price unilaterally at a low rate;

Nevertheless, around December 31, 2010, the Defendant: (a) at the office B located in Geumcheon-gu Seoul Metropolitan Government, the subcontractor’s actual operator, and (b) at the office B located in Geumcheon-gu Seoul Metropolitan Government, the Defendant unilaterally agreed on the unit price reduction of KRW 600, KRW 64, the current unit price change of KRW 60, KRW 50, and KRW 50, the Nego 5% from January 201; and (c) at the time when the unit price reduction is applied, the Defendant unilaterally agreed on the unit price reduction of KRW 1,235, a total unit price reduction of KRW 1,50,00 from around February 7, 2011 to April 9, 2012; and (d) at the rate of KRW 1,235, a total price reduction of KRW 1,54,521, a unit price reduction of KRW 360,521 without justifiable reasons, as indicated in the attached list of crimes.

2. Defendant B, a representative director of the Defendant, committed a violation as described in paragraph (1) in relation to the Defendant’s business at the time and place of paragraph (1).
