A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons
Punishment of the crime
[2014 Highest 2161] The Defendant is the representative of Q Hospital Q Hospital, who runs a general hospital business using 40 regular workers.
The Defendant is working at Q Hospital located in Qu District R around June 30, 2013, and from August 16, 2012 to June 15, 2013.
The 6,111,150 won in total, including the 2,307,700 won in May 2013, was not paid within 14 days from the date of retirement without agreement between the parties on the extension of the due date.
In addition, the Defendant did not pay 63,162,439 won in total to 13 retired workers within 14 days from the date of retirement, such as No. 1,2, 3, 5, 6, 7, 7, 8, 11, 15, 19, 20, 20, 25, and 26 No. 1, 2, 3, 5, 6, 7, 8, 15, 19, 200,
[2014 Highest 5520] The Defendant, as the representative of the PMedical Foundation Qaum Hospital located in the Republic of Korea-si R, is an employer who ordinarily employs 30 workers and operates a general hospital.
The Defendant did not pay the total amount of KRW 45,476,513, including wages of 15 workers, within 14 days from the date of retirement in which the cause for payment occurred, without agreement between the parties on the extension of the due date for payment between them, as stated in the attached Table of Crimes (2), including Telecommunication’s wage of KRW 981,260 in February 2014, which had been worked from October 21, 2013 to April 24, 2014.
In addition, the Defendant did not pay 5,295,864 won in total, including 3,506,384 won in U’s retirement pay balance and 5,295,864 won in V’s retirement pay from March 1, 2013 to March 31, 2014, within 14 days from the date on which the cause for such payment occurred, without any agreement on extension between the parties’ payment dates.
