Defendant

The defendant shall be punished by imprisonment with prison labor for three months for each crime set forth in A's holding, and imprisonment with prison labor for five months for each crime set forth in the holding.

Punishment of the crime

Defendant

A was sentenced to two years of imprisonment for a violation of the Game Industry Promotion Act at the Incheon District Court on June 22, 2012, and the judgment was finalized on June 30, 2012.

1. Defendants in violation of the Game Industry Promotion Act agreed to operate illegal speculative game room business with one name F, G, and H. Defendant A conspired to share the management of overall operation of the game room as the game room business owner, Defendant B’s store management, and H’s job performance with one name F, G, and H, respectively.

No person who violates the Game Industry Promotion Act due to the provision of unregistered game products shall provide game products for use, or display or keep them for such purpose by the Game Rating Board.

Nevertheless, the Defendants conducted their respective roles with F, G, and H as above, and provided an unspecified number of customers with a PC which was set up in a game room without a trade name in the first second floor from February 18, 201 to February 27, 2011, which had not been classified by the Game Rating Board from Bupyeong-gu, Seocheon-gu.

(b) No person in violation of the Promotion of the Game Industry Act due to money exchange shall engage in business of exchanging or arranging money exchange or re-purchasing intangible results obtained through the use of game products;

Nevertheless, in collusion with F, G, and H, the Defendants exchanged points obtained through the above “Snoland” game in exchange for cash of KRW 10,000 per 10,000.

(c) Game products related business entities that violate the Game Industry Promotion Act by causing them to perform speculative acts shall be engaged in gambling and other speculative acts using game products, or shall be engaged in such gambling and other speculative acts;
