1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. As to the legality of a lawsuit, the Plaintiff did not have a document submitted under the title of the complaint of this case (hereinafter referred to as the “written complaint”) submitted on December 26, 2016, without distinguishing the purport of the claim and the cause of the claim in the complaint of this case (hereinafter referred to as the document of this case) and received a superior action due to the company’s violence, the Plaintiff’s unfair dismissal is null and void and the party’s punishment and reinstatement from office
I wish to compensate for the original position and loss.
The act of forced submission of resignation is illegal.
In other words, I want to render a favorable judgment of the Plaintiff for the sole purpose of the Company
On February 21, 2017, the participatory officer of this Court stated “The purpose of the claim is to clarify the purport of the claim and to state the reasons for the claim in detail.”
The Plaintiff issued an order of correction, stating that “The Plaintiff was ordered to make a correction,” and the Plaintiff submitted a document stating only similar reasons on March 14, 2017, June 14, 2017, and June 26, 2017, and did not clearly state the purport of the claim and the cause of the claim. Meanwhile, on June 26, 2017, the Plaintiff was also the Defendant B as the Defendant at the first preparatory date for pleading, and confirmed that the dismissal against the Plaintiff on June 26, 2010 is null and void. The Defendants paid the Plaintiff the money equivalent to the wages the Plaintiff received from around 2010 until his/her reinstatement. The Defendants are reinstated to the Plaintiff. The Defendants are claiming that “the Plaintiff paid the hospital expenses, etc. paid by the Plaintiff due to dismissal,” and that “the Plaintiff was forced to resign from the company to the surrounding people by force.”
“A statement was made as the cause of the claim.”
In civil procedure, the contents and scope of claims should be clearly identified in accordance with Article 249(1) of the Civil Procedure Act, and the grounds for claims that can be justified should also be stated.
