1. Of the judgment of the court of first instance, the part against Defendant Republic of Korea is modified as follows.
The plaintiff is the defendant.
Reasons
1. Basic facts
A. AE and AF (no specific co-ownership shares are written) as to the land of this case among the real estate listed in the separate sheet in the real estate list in the land survey register and the land survey register prepared under the former Decree on Land Survey (Ordinance No. 2 of August 13, 1912) as to each real estate listed in the separate sheet in the separate sheet, when referring to each of the above real estate (hereinafter referred to as “each of the above real estate”), and as to the land of this case among the real estate listed in the separate sheet in the separate sheet, AG and AF (no specific co-ownership shares are stated) as to the land of this case, and as to the land of this case No. 3, AG and Defendant B are listed as the name of each circumstance, and as to the land of this case, the above circumstance is listed as the owner of the pertinent land in the previous land cadastre
(hereinafter referred to as the “instant assessment titleholder”) b. by referring to the assessment titleholder of each of the instant lands.
The defendant Republic of Korea, who has made a registration of preservation of ownership on each of the land of this case, completed the registration of preservation of ownership in his name (hereinafter “registration of preservation of ownership in this case”) by the Suwon District Court, Yangyang-gu District Court No. 23837, Dec. 12, 1995.
C. AH (Death on August 15, 1946), the head of the network AE, and AH (Death on January 27, 1997), the deceased were inherited solely by the deceased. The deceased’s heir of the network AI (including inheritance by representation, hereinafter the same shall apply), the J (Death on April 21, 2016), AL (Death on June 5, 1964), AK (Death on January 4, 201), the Defendant U.N. (Death on January 4, 201), as the heir of the network AE, his brothers and sisters and sisters (Death on August 15, 194), BF (Death on July 12, 197), BG (Death on January 20, 197), and BF (Death on January 14, 1974), and B0 (Death on January 29, 201).
As the heir of the network BK, there are Defendant BN, BO, and BP, the wife of Defendant BM, and Defendant BB, the wife of the network BL, and the heir of the network BL.
