Punishment of the crime

[The circumstances leading up to the case] The N(O) is established on October 1, 1996 and aims at the electric cable manufacturing business in the PP in the Gyeong-gun of Seongbuk-gu, Seongbuk-gu, and is 87 full-time workers and 160 billion won annual sales.

The NMMM NM Round is a trade union consisting of 36 union members (46 members at the time of establishment of May 21, 2015).

The NMMNN (hereinafter referred to as the “NMNM”) claimed a fixed amount of KRW 159,90,00 based on basic pay, 900% payment of bonus ordinary wage, and the recognition of partnership activities during working hours, and concluded a wage agreement and a collective agreement between the first and the sixth labor-management negotiations between July 1, 2015 and July 29, 2015.

Despite the negotiations, the Nnoster, which did not enter into the agreement, approved the industrial action by voting on August 7, 2015, and started to the general strike on August 11, 2015.

As from August 17, 2015, Nno union temporarily withdrawn from the strike in accordance with the labor-management agreement, which refers to the centralized bargaining from August 17, 2015, and was placed in the full strike from August 18, 2015 to the replacement notification of the negotiating members.

On September 30, 2015, N Co., Ltd.: (a) partially closed the workplace on September 30, 2015; and (b) NM, on December 9, 2015, held the “NM-U.S. Resolution on the NMM-U.S. Sub-chapter Resolution”; and (c) on December 18, 2015, “a company representative’s detention investigation and labor-management resolution meeting” (hereinafter “N”) closed the entire workplace on December 24, 2015.

In addition, when converting N into a partial lock-out on January 25, 2016, it publicly announced that if it is not possible for union members to return to work, they will recruit human resources to normalize their operation.

A is the chief of the organization of the above NM, and Defendant B, Defendant C, Defendant D, and Defendant D.
