Punishment of the crime

[criminal history] On February 11, 2015, the Defendant was sentenced to one year and two months of imprisonment for fraud in the original state branch of the Chuncheon District Court, and was serving in the Chuncheon Prison on February 29, 2016, and the parole period expired on April 12, 2016.

[ 범죄사실] 피고인은 2017. 7. 1. 22:26 경부터 2017. 7. 2. 06:35 경 사이에 이천시 C 빌딩 지하 1 층 사무실에서 성명 불상의 사람들을 불러 모은 후, ‘ 총책( 거액의 도박자금을 소지하여 나머지 사람들을 상대로 도박을 하는 사람을 지칭) ’으로 하여금 화투 48 장 중 20 장을 이용하여 5 장씩 4패를 놓도록 하여 총책이 1패를, 나머지 사람들이 남은 3패 가운데 1패를 선택하여 총책이 건 금액의 한도 내에서 돈을 건 다음, 자신이 선택한 패의 화투 5 장 중 3매를 이용해 10 내지 20을 만들어 버리고, 나머지 2 장을 가지고 그 끝수와 미리 정해진 ‘ 족 보 ’에 따라 높은 쪽이 이기는 방법으로 승패를 정하여 총책과 겨루는 속칭 ‘ 도리 짓고땡’ 이라는 도박을 수십 회에 걸쳐 하도록 하고, 도박에서 이긴 사람으로부터 돈을 딴 금액의 5% 상당을 고리로 받는 방법으로 도박장을 개설한 것을 비롯하여, 그 때부터 2017. 8. 2. 경 사이에 별지 범죄 일람표의 기재와 같이 모두 22회에 걸쳐 같은 방법으로 도박장을 개설하였다.
