1. The Defendant’s KRW 55,348,298 as well as the Plaintiff’s annual rate from April 24, 2014 to February 3, 2016.
Reasons
1. Occurrence of liability for damages;
A. The facts of recognition 1) BHE awarded a contract to the Defendant for the improvement of D interior in Gwangju Mine-gu C, and the Defendant awarded a contract for the part of the toilet (hereinafter “instant construction”).
1) The State of Ghana (hereinafter referred to as the “State of Ghana”)
(2) The representative F of E had employed G, H, I, and the Plaintiff for the instant construction, and had them remove concrete fireproof walls at the construction site as of April 24, 2014.
3) During the above removal work, the parts of the above four persons were smoked while playing a rest. At around 14:00 on the same day, the Plaintiff, who did not smoked from tobacco, was engaged in crushing work without confirming whether G was the Plaintiff and contained concrete sculptures inside the toilet, and the Plaintiff was exposed to an accident involving the concrete further in concrete (hereinafter “instant accident”).
4) Due to the instant accident, the Plaintiff suffered injury, such as the pressure frame and druplicule damage of the first place of pressure.
5) Even though the Defendant subcontracted the instant construction to the Nae-do-ro, it did not report it to or obtain the consent from the ordering person, and only reported only to the J as an on-site agent, and did not report F, K, and L as an on-site supervisor at the time of the instant accident. 6) The Defendant reported F and K as the Defendant’s employee at the time of the instant accident at the time of the instant accident.
