Reasons
Punishment of the crime
Since the outbreak of a brain disease (e.g., 23 years of age) around December 2012, the victim C (e.g., the victim) was a person who lost his/her normal ability to determine the situation because he/she is proceeding at a serious speed, such as memory and intelligence decrease.
1. On June 26, 2015, at around 12:00, the Defendant: (a) discovered that the said victim was going up in the apartment complex in front of Gyeyang-gu Incheon apartment 304 Dong, Gyeyang-gu, Incheon, with a view to having sexual intercourse with the victim using his mental and physical loss; (b) had access to the victim to the victim that “I want to buy a new post”; (c) had the victim put the victim into the vehicle owned by the Defendant Esletomom; and (d) had the victim go up to the boundary by sending a new post at the place; and (e) had the victim go up to 207 Gel in Gyeyang-gu, Incheon at around 14:30 on the same day.
Accordingly, the defendant inducedd the victim for the purpose of sexual intercourse.
2. At around 14:30 on June 26, 2015, the Defendant: (a) exempted the victim’s clothes from all of the victim’s clothes; (b) went off the victim’s clothes; and (c) went off the victim’s chest and her clothes into the toilet; and (d) talked with the victim’s chest and turbing the victim’s fingers into the part of the victim’s drinking part; (b) her knick the victim’s knife in the back; (c) her knife the victim; and (d) her knife the victim from the toilet and the victim’s knife the victim’s knife on the part of the victim’s knife; and (d) her knife the victim’s chest and the victim’s knife with the victim’s chest and knife the victim’s chest.
Accordingly, the defendant did not commit rape by taking advantage of the mental and physical loss of the victim, but did not commit an attempted rape.
