A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 11, 2006, the Defendant received a summary order of KRW 700,000 from the Seoul Central District Court to a fine for a violation of the Road Traffic Act, and a summary order of KRW 2 million as a fine in the same court on May 20, 2009.

The defendant is a person engaged in driving a gallon car.

On July 17, 2013, the Defendant driven the said car while under the influence of alcohol of 0.132% of blood alcohol concentration on July 17, 2013, and driven the said car along the five-lane road prior to the approval of the National Assembly of Yeongdeungpo-gu Seoul Metropolitan City National Assembly, Yeongdeungpo-gu, Seoul, along the two-lanes from the Western intersection.

At the time, there was an intersection where signal lights are installed at night and at the front, so a person engaged in driving of a motor vehicle has a duty of care to safely drive the front door and prevent accidents in advance by driving the motor vehicle in accordance with the traffic signal.

Nevertheless, the Defendant, while neglecting his duty to drive and proceed with the said car while driving the said car in front of the traffic signal at the front of the vehicle, did not immediately discover and avoid the Dsch Rexroth driver car of the victim C (the age of 45) who was in front of the traffic signal at the front of the vehicle and did not avoid the vehicle, and the Defendant’s behind the said gallon vehicle with the front part of the said gallon vehicle as the front part of the said gallon vehicle, caused the said gallon car to be pushed by the front part of the said gallon vehicle, and the said f.m. part of the victim E (the age of 60) who was in front of the said f.m. in front of the said f. passenger vehicle, and turn back to the shock of the first accident.
