A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Around September 2013, the Defendant was married with the victim B (here, 33 years of age) on and around September 2013, and his marriage began separately from the other male on and around March 2, 2018.

1. On October 2, 2017, the Defendant reported the victim B’s mobile phone text message at the Defendant’s residence in Kimhae-si, Kimhae-si, OOOOOOO, and was suspected of having done an external dispute with another male. On the other hand, the Defendant saw the victim B’s cell phone text message at three times, left the victim B’s toy joints with the victim’s eye, and got off the victim B’s buck, head, telegraph, etc. by drinking.

Accordingly, the defendant assaulted the victim B.

2. Intimidation;

가. 2018. 3. 17.자 협박 피고인은 2018. 3. 17.경 김해시 D에 있는 ‘E’ 식당에서 피고인이 근무하는 회사 직원들과 회식을 하던 중 피해자 B이 다른 남자를 만나고 다닌다는 이유로 화가 나, F으로 피해자 B에게 “니는 어디가서 G 엄마라고 처 씨부리면 혓바닥 다 뽑아 버린다. 니가 키가 있다이가 변명 개좆같이 하면 느그부모 장사밑천도 쌍그리 없애버린다. 내 양아치 새끼소리 들었다. 나 이래뵈도 기장 바닥에서 존나게 패싸움해가며 깡다구 기른 새끼다. 그동안 니한테 티를 안 낸거지. 이제 내 날개를 어찌펴나 잘봐라. 피똥쌀거다. 근데 니 협박 진짜 받은 거 같네. 내한테 이래 F도 하고. 나 소싯적에 내 가난하다고 놀린 놈 일광 바닷속에 담궜던 놈이다. 10년 동안 니 만나서 그런 모습을 안 보였던거지. 니 피똥 쌀거다.”라는 문자메시지를 전송하여 피해자 B를 위협하였다.

Accordingly, the defendant threatened the victim B.

B. On April 22, 2018, the Defendant of intimidationd on April 22, 2018: (a) around 02:29, Kimhae-si, and (b) even when the victim H (the aged 61) was aware of the male relationship in the above B, the Defendant was wn up the said B.
