1. Of the judgment of the court of first instance, the part concerning the land indicated in paragraph (2) of the attached list shall be revoked, and the revoked part shall be applicable.
Reasons
1. Basic facts
A. The Plaintiff’s lighting net H (Death on July 7, 1960) had five son, J, K, L, and M.
The deceased I and the wife have O, the plaintiff, P, the network G (the deceased on December 7, 1995, hereinafter "the deceased") is the son of J, and Q is the son of Q.
The wife of the deceased is R, and his children are Defendant B, C, D, and E (hereinafter “Defendant B, etc.”) and network S, and the network S’s wife is T, V, and W.
B. The network H was assessed on each land listed in the separate sheet (hereinafter “each land of this case”).
C. On January 18, 1965, O, the deceased H’s senior grandchildren, completed registration of preservation of ownership on the land listed in [Attachment List No. 1] (hereinafter “instant land”).
O was missing from December 20, 1965, Q and the Deceased, the fourth degree of shape of O, from among the land in the instant case, completed the registration of transfer of ownership on the ground of sale on January 7, 1970 under the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3562, hereinafter “Special Measures Act”), No. 11134 on April 29, 1985, and completed the registration of transfer of ownership on the ground of each 1/2 share of the land in the attached Table No. 2 (hereinafter “the land in this case”) in accordance with the Act on Special Measures for the Registration, etc. of Ownership of Real Estate.
E. As the Deceased died on or around December 7, 1995, R, wife of each of the instant lands, as to the shares of 27/234 shares, Defendant B, etc., their children, respectively, as to the shares of 18/234 shares; T, U, V, and W, as to the shares of 6/234 shares of 6/234 shares, on December 7, 1995, as to the shares of 4/234 shares of 4/234 shares, the Chuncheon District Court No. 69403, Dec. 30, 2008 (hereinafter “instant transfer registration”).
F. Defendant F is the Chuncheon District Court with respect to Defendant B’s share of 18/234 out of each of the instant lands.
