A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person who operates the “D” in the B building C in Gyeonggi-do.
1. The Defendant in violation of the Medical Service Act did not obtain the recognition of a massage club, and from August 30, 2018 to September 28, 2018, established a massage clinic without qualification by having his/her employees provide massage services without being qualified as a massage club, by getting his/her employees to enjoy the payment of KRW 110,000 to KRW 120,00 per person for each customer who visits the said “D” and received the payment of KRW 120,00 for each customer who visits the said place, on his/her hand, from around August 30, 2018 to around September 28, 2018.
2. Violation of the Punishment of Arrangement of Commercial Sex Acts;
A. On September 22, 2018, the Defendant: (a) received 220,000 won per head of 110,000 won in total from two customers, including E, who found at the immediately preceding marina business establishment on September 22, 2018; (b) directed 1,20,000 won per head of 1,10,000 won in the price for marina and sexual traffic; and (c) led F and G, a female of her mother, to enter the said heading room and to have them sexual intercourse with customers.
B. On September 28, 2018, the Defendant: (a) received 240,000 won per head of 1,20,000 won in total from two customers H, etc., who were found in the business place of the above marina on September 28, 2018; (b) directed 1,20,000 won per head of her marina and sexual traffic; and (c) led I and J, a female of her mother, to have sexual intercourse with the above customers, respectively.
C. From April 2, 2019 to April 25, 2019, the Defendant at around 20:20 on April 25, 2019, and around 240,000 won per head at a discount of 2,10,000 won among the total sum of 2,40,000 won per head from two customers K, etc., and the price for sexual traffic, he/she shall receive 2,10,000 won per head, and guide 2,3,000 won, and let L and M enter the above heading room and have them have sexual intercourse with their customers, as well as around 13 days from April 2, 2019 to April 25, 2019.
