A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 00:30 on December 31, 2012, the Defendant: (a) under the influence of alcohol at around 00:30 on December 31, 2012, in the process of putting the victim C, the victim D's daily driving, and the taxi into a knife; (b) knife (34 cm in total length, 200 cm in blade length) which is dangerous goods at the near’s frequency of mutual incompetence; and (c) expressed the desire for the victims to “the knife, knife, knife,” and expressed the attitude of knifeing the knife of the above knife, the victims’ life and body, and any harm and injury to the victims.

Accordingly, the defendant carried a knife, which is a dangerous thing, and threatened victims.

2. 폭력행위 등 처벌에 관한 법률위반(집단ㆍ흉기 등 협박), 특수공무집행방해 피고인은 제1항 기재 일시, 장소에서, 위 C으로부터 신고를 받고 출동한 인천남동경찰서 E지구대 소속 경사 F, 순경 G으로부터, 피고인이 위와 같이 술에 취하여 위험한 물건인 위 회칼을 들고 거리를 돌아다니고 있으므로 불특정 시민들에게 위해를 가할 위험이 있어, 수회에 걸쳐 회칼을 내려놓으라는 요구를 받고도 이에 불응하면서 위 경찰관들에게, “씨발 내가 머, 칼 들고 가는 건데”라고 욕설을 하고, 위 순경 G이 위협을 느껴 피고인을 제압하기 위하여 소지하고 있던 테이저 건을 꺼내자 “테이저 건이네, 씨발 쏴 볼 테면 쏴봐라”라고 욕설을 하면서, 회칼을 들고 위 경찰관들 약 1m 정도 거리로 가까이 다가가, 경찰관들의 생명, 신체에 어떠한 위해를 가할 듯한 태도를 보였다.

Accordingly, the Defendant, carrying a knife, which is a dangerous object, prevented police officers from performing their legitimate duties on crime prevention and suppression of police officers.
