1. Basic facts

A. A Co., Ltd. (hereinafter referred to as “debtor”) C (hereinafter referred to as “C”)

A) On September 9, 1998, the Seoul Central District Court applied for the commencement of composition to the Seoul Central District Court on September 12, 1998, and received the decision to authorize the commencement of composition on January 8, 1999. (2) The debtor company is a company established by division C on September 17, 2001.

B. From May 18, 2010 to June 17, 2011, an obligor company preparing a notarial deed of the obligor company prepared and issued each of the notarial deeds as listed below (hereinafter “instant notarial deeds”) to the Defendants. Each of the notarial deeds of this case includes an expression of intent to recognize compulsory execution that “if the obligor company fails to perform the pertinent monetary obligation, it shall immediately be subject to compulsory execution, and there is no objection thereto.”
